2. Introduction

These Terms of Service (the "Terms") govern your use of the Service available at rendeles.lajtarjudit.hu (the "Service"). By registering an account, logging in, accessing a gallery via a QR code, or placing an order, you (the "Parent" or "User") accept these Terms.

2.1 The photo session and parental consent

The survey of interest and the parental consent regarding the photographing of children are collected by the institution concerned (kindergarten, school) before the session, under its agreement with the Operator. These Terms apply only after the session has taken place, to viewing, selecting and ordering the resulting photographs through the Service. They do not govern the photo session itself or how consent to participate is obtained; the institution informs parents about that.

3. Accounts and access

  • The Service can be used in two ways: (a) with a personal QR code issued by the Operator for a specific child and photo session; (b) with a parent account created during QR activation or by separate registration (with an optional invitation code).
  • On first QR entry you must set a password, which creates the parent account linked to that QR code.
  • You are responsible for keeping your credentials and QR code confidential, and for all activity through your account.
  • The Service is available to private individuals (parents, legal guardians) only. Corporate use is not supported.
  • Only a natural person aged 18 or over with legal capacity may use the Service.

4. Gallery access with a QR code or invitation code

  • Each QR code grants access to exactly one child profile and one institutional photo session.
  • QR access expires automatically at the ordering deadline set for that session. After expiry, the gallery and the QR link become inaccessible.
  • An invitation code grants access to the photographs of the child's own group/class until the stated deadline.
  • The Operator may revoke or regenerate a QR code at any time; earlier codes then stop working.

5. Orders and payment

  • Orders must be placed before the ordering deadline shown in the gallery. After the deadline the gallery is deleted.
  • Placing an order, accepting these Terms (via the checkbox at checkout) and pressing the order button that expressly states the payment obligation constitute a binding offer to purchase by the User.
  • The contract is concluded when the Operator confirms the order. Performance is conditional on payment of the full purchase price.
  • The User receives a confirmation of the contract and of the order contents at the e-mail address provided. If no confirmation arrives within 48 hours, the User is released from the offer.
  • The confirmation and the electronic invoice are sent to the e-mail address given at checkout.
  • Invoices can only be issued to a private individual. The billing name must be the name of a natural person; invoicing to a company is not supported. The Operator is a KATA private entrepreneur and therefore issues VAT-exempt invoices.

5.1 Payment method – bank transfer

  • The only payment method currently available is bank transfer to the Operator's account:

  • The order number shown in the order confirmation must be entered in the payment reference (memo) field. It identifies the payment; without it, performance may be delayed.
  • Please make the transfer within 3 business days of placing the order. Reminders are sent for unpaid orders.
  • Production and the delivery of digital photos begin once the purchase price has been received.
  • If the purchase price does not arrive by the ordering deadline of the given photo session, the Operator may cancel the order after prior notice by e-mail.

5.2 Payment method – card (Barion) – currently unavailable

Card payment is currently not available in the Service; if it is introduced, you will be informed on the checkout page. If introduced, the following applies.

  • Card payments are processed by Barion Payment Zrt. (registered seat: 1117 Budapest, Infopark sétány 1., Hungary; licensed electronic money institution, licence number H-EN-I-1064/2013) through the Barion Smart Gateway.
  • Accepted cards: Visa, Visa Electron, Mastercard, Maestro, Apple Pay (on supported devices). Payment is possible with or without a Barion wallet.
  • The Operator neither sees nor stores your card number or CVC code; these are entered directly into Barion's PCI-DSS certified system over an encrypted channel.

  • Any refund is initiated by the Operator through Barion, and is returned to the original card.

5.3 Delivery times

  • Digital products: delivered electronically through the order page of the Service once retouching is complete. Typical delivery time is 1–3 weeks from payment, depending on the complexity of retouching and the production queue.
  • Physical products (prints, photo products): production likewise typically takes 1–3 weeks from payment; finished products are handed over at the institution. The exact time and place of collection is communicated separately by the Operator or the institution.
  • The User is informed by e-mail in advance of any material deviation from these delivery times.

5.4 Immediate supply of digital content

Because digital products are typically performed within the statutory 14-day withdrawal period, when placing an order that contains digital products the User makes a separate, express declaration before payment, as follows:

"I expressly request that the supply of the digital content begin before the withdrawal period expires, and I acknowledge that I thereby lose my right of withdrawal in respect of the digital content (Government Decree 45/2014. (II. 26.) § 29(1)(l))."

Without this declaration, the Operator begins performance of the digital product only after the 14-day withdrawal period has expired.

6. Acceptable use

You agree not to:

  • share your QR code, credentials or download links with third parties;
  • download, copy, publish or distribute the photographs beyond private family use;
  • attempt to circumvent authentication, access limits or other technical protections;
  • upload content to the Service.

7. Intellectual property

Copyright in the photographs remains with the photographer. By purchasing digital or physical products you receive a personal, non-exclusive, non-transferable licence to use the images for private, non-commercial purposes. Public publication (in particular commercial publication on social media), resale or commercial use requires prior written permission. As the photographs are of minors, observing the ban on public publication is also a matter of child protection — please do not publish a photograph of another person's child without that parent's consent.

8. Consumer rights, withdrawal and warranty

8.1 Physical (printed) products – right of withdrawal

As physical products are made individually for the specific child (individual retouching, printing), under § 29(1)(c) of Government Decree 45/2014. (II. 26.) the statutory right of withdrawal cannot be exercised once production has begun.

8.2 Digital products – right of withdrawal

For digital content not supplied on a tangible medium (e.g. downloadable digital images), under § 29(1)(l) of Government Decree 45/2014. (II. 26.) the User loses the right of withdrawal if performance has begun with the User's express prior consent and the declaration under section 5.4. Without such a declaration, the User retains the 14-day right of withdrawal for digital content as well.

8.3 Warranty for defects

In case of defective performance, the User has warranty rights under §§ 6:159–167 of Act V of 2013 on the Civil Code. The User may — at their choice — request repair or replacement, unless performing the chosen remedy is impossible or would cause the Operator disproportionate additional cost. If repair or replacement was not or could not be requested, the User may request a proportionate price reduction, may repair the defect at the Operator's expense or have it repaired by another party, or may withdraw from the contract if the Operator did not undertake or cannot perform repair or replacement. Warranty claims may be enforced within 2 years of performance. The User must notify the Operator of a defect without delay after discovering it.

9. Complaints and enforcement

  • The User may raise complaints about the Service or its performance at the e-mail address or phone number given in section 1. The Operator responds to complaints submitted in writing within the deadline set by Act CLV of 1997 on consumer protection (30 days).
  • If the complaint is not resolved directly, the User may turn to the conciliation body (békéltető testület) competent for their domicile or residence or, failing that, for the Operator's registered seat, for out-of-court resolution of the consumer dispute. The body competent for the Operator's seat:

  • The User may also turn to the Hungarian National Authority for Data Protection and Freedom of Information (NAIH) and to the consumer protection authority.

10. Liability

  • The Service is provided "as is". The Operator does not guarantee uninterrupted availability.
  • The Operator is not liable for damage caused by a QR code, password or download link leaked within the User's sphere of control.
  • These Terms do not exclude liability that cannot be limited under Hungarian law.

11. Data protection

Personal data is processed in accordance with the Privacy Notice available in the Service, which forms an inseparable part of these Terms.

12. Changes

The Operator may amend these Terms unilaterally. New versions are published in the Service. Acceptance of the Terms is requested at every checkout via the checkbox, so you always accept the version in force at the time of your order. Amendments do not apply to orders already placed and confirmed; those are governed by the Terms in force when they were placed.

13. Governing law

These Terms are governed by Hungarian law. Hungarian courts have jurisdiction over any disputes.
